NCPCR writes to NIOS over Jamiat Open School for Classes 3, 5, 8

New Delhi, March 14, 2024: The National Commission for Protection of Child Rights (NCPCR) has written to the National Institute of Open Schooling (NIOS), seeking details regarding the open school being operated by Jamiat Ulama-i-Hind in partnership with the institute. NCPCR has urged NIOS to discontinue these courses and ensure the enrollment of students in formal schooling.

Key Points:

Nature of Collaboration: NCPCR has taken cognizance of a complaint regarding the open school run by Jamiat Ulama-i-Hind, in collaboration with NIOS, which aims to provide mainstream education to Madrasa students.

Violation of RTE Act: NCPCR argues that offering open schooling for Classes 3, 5, and 8 violates the Right to Education (RTE) Act. It questions the necessity of providing education through open schooling at the elementary level when there are a sufficient number of government schools available.

Financial Concerns: NCPCR has raised concerns about fund-raising activities conducted by Jamiat Ulama-i-Hind in the UK based on the alleged collaboration with NIOS. It seeks clarification on the fee-sharing arrangement between NIOS and Jamiat Open School and questions the need for raising funds beyond the expenditure on open schooling.

Legal Action: NCPCR accuses the organization of depriving students enrolled in open schooling of essential facilities such as midday meals, uniforms, and trained teachers. It directs NIOS to discontinue these courses and set up a committee to investigate the officials responsible for allowing the opening of the school.

Action Taken by NCPCR:

NCPCR has requested NIOS to provide details of any agreement between NIOS and Jamiat Ulama-i-Hind or its affiliated entities.

It has asked for information on the fee-sharing arrangement between NIOS and Jamiat Open School, as well as the list of study centers and teachers associated with the program.

NCPCR emphasizes the importance of safeguarding the rights of children and ensuring their access to quality education within the framework of the RTE Act.

Conclusion: The inquiry by NCPCR highlights concerns regarding the operation of open schooling for Madrasa students and calls for transparency and accountability in the collaboration between NIOS and Jamiat Ulama-i-Hind.
