The CBSE three-language policy remains under active judicial scrutiny, with the Supreme Court having fixed 29 July 2026 as the date for a detailed hearing on fresh petitions challenging the mandate. As of now, no official outcome of that hearing has been reported, and the policy continues to operate without any interim stay.

What the CBSE three-language policy Mandate Requires

Under CBSE’s revised Secondary School Curriculum for Classes IX-X (2026-27), along with circulars dated 9 April 2026 and 4 May 2026, students from Class 6 onwards must study two languages classified as “native to India,” alongside a third language option.

Petitioners argue this framework was rolled out abruptly, after the academic session had already begun, leaving many schools to discontinue foreign languages like French, German, or Spanish and default to Sanskrit instead. In several CBSE-affiliated English-medium schools, English itself has been treated as the “foreign” language slot rather than a native one, a classification petitioners are directly disputing before the court.

What the Supreme Court Has Decided So Far

A bench led by Chief Justice of India Surya Kant, along with Justices Joymalya Bagchi and V. Mohana, has declined to grant an interim stay on the policy at every stage so far. The court issued notice to the Centre, CBSE, and NCERT, seeking their response within two weeks, and fixed the fresh batch of petitions for detailed hearing on 29 July 2026.

Separately, in an earlier round tied to the Class 9 mandate, the court indicated it would examine practical concerns such as teacher availability and textbook shortages, while reserving constitutional questions — including whether English can be classified as a non-native language — for the final hearing. The bench also stated it would step in if any action were taken against teachers for not implementing the policy.

Outcome of the July 29 Hearing Still Awaited

As of the time of writing, there is no confirmed report on what transpired at the 29 July 2026 Supreme Court hearing. Readers are advised to treat any claims of a final ruling with caution until an official order or credible court reporting becomes available. This page will be updated once verified details of the hearing emerge.

What This Means for Students and Parents

Until the Supreme Court delivers a final ruling, the CBSE three-language policy mandate remains in effect for CBSE-affiliated schools. Parents whose children have already been shifted into Sanskrit or another Indian language as a replacement for a previously chosen foreign language should continue following school-level guidance, while staying alert for updates from the ongoing litigation. Petitioners have also raised concerns under the Right to Education Act, arguing that curriculum changes for elementary classes require NCERT’s formal notification, an issue the court is yet to rule on.
